O deputado Roberto Costa (PMDB), esteve hoje (09), na Ordem dos Advogados do Brasil (OAB), para apresentar ao presidente Mario Macieira, uma representação solicitando que a Entidade entre com um Ação de Inconstitucionalidade da Lei Municipal nº 3.392/2010 que atualizou a Planta Genérica de Valores dos Imóveis de São Luís. Após inúmeras reclamações da população pelo aumento do IPTU, o parlamentar iniciou um levantamento de dados e deparou-se com o Processo Administrativo Investigatório da promotoria de Justiça da Defesa da Ordem Tributária e Econômica, cujo titular é o Dr. José Osmar Alves, que fez a denuncia ao Ministério Público Estadual, através de um relatório circunstanciado, robusto de provas. “Estamos aqui para pedir a OAB que interceda através de uma ação nesse processo investigatório feito pelo Ministério Público. Não podemos aceitar um absurdo como este, por essa razão, estou pedindo o apoio dessa instituição tão séria como é a OAB”, declarou o deputado. “Já tínhamos alguns membros da OAB acompanhando o caso, mas agora, com a representação do deputado iremos levantar um relator e na próxima sessão da seccional iremos nos decidir qual será o nosso procedimento”, disse o presidente Mário Macieira.
Prefeito de Peritoró responderá ação penal no TJ
A 3ª Câmara Criminal do Tribunal de Justiça recebeu, na sessão desta segunda-feira, 9, denúncia contra o prefeito de Peritoró, Agamenon Lima Milhomem. Ele foi denunciado pelo Ministério Público Estadual, acusado de não ter prestado as contas municipais referentes ao exercício financeiro de 2009, perante o Tribunal de Contas do Estado (TCE). O prefeito passará a responder ação penal pela suposta prática de crime previsto no Decreto-Lei 201/67, que trata dos crimes de responsabilidade de prefeitos e vereadores. Agamenon Milhomem defendeu que a acusação não se sustentaria, pois teria encaminhado as contas, embora em atraso. O relator do caso, desembargador Joaquim Figueiredo, decidiu receber a denúncia, entendendo que estavam presentes a materialidade e indícios da autoria do crime. Segundo ele, na fase inicial se verifica apenas a viabilidade da acusação em tese, devendo a existência ou não do dolo ser analisada durante a fase de instrução. O desembargador Benedito Belo acompanhou o relator, pelo recebimento da denúncia mesmo que a prestação de contas tenha se dado em atraso. O voto também seguiu parecer da Procuradoria Geral de Justiça (PGJ).
TRT-MA determina Banco Santander indenizará ex-empregada por dano moral
Os desembargadores da 1ª Turma do Tribunal Regional do Trabalho do Maranhão (TRT-MA) decidiram que o Banco Santander Brasil S.A (sucessor do Banco ABN AMRO Real S.A) pagará indenização por dano moral a ex-empregada que foi obrigada a vender 10 dias de suas férias anuais. Segundo os desembargadores, a CLT (Consolidação das Leis do Trabalho) diz, no artigo 143, que é facultado ao empregado a conversão de 1/3 das férias em abono pecuniário. Dessa forma, trata-se de uma opção disponibilizada ao empregado e não de uma ordem indireta imposta pelo empregador. Os desembargadores julgaram recursos ordinário e adesivo interpostos pelo Banco Santander Brasil S.A e a reclamante G.C.C contra a sentença do juízo da 1ª Vara do Trabalho de São Luís, que condenou o banco (reclamado) a pagar à reclamante horas extras trabalhadas além da jornada legal de 8 horas diárias e indenização por dano moral no valor de R$ 20 mil.

Engenheiro civil de alta competência, Leal era um dos mais antigos colaboradores do Estado, tendo deixado sua marca de dinamismo e dedicação ao serviço público em três décadas de trabalho em diversos órgãos, chegando a ocupar o cargo de secretário de Infraestrutura do governo Roseana no período de abril a dezembro de 2010. Roseana Sarney se solidarizou com a mulher, os dois filhos e amigos do engenheiro, e lastimou a perda. “O Estado perde um profissional de competência reconhecida e também um homem de grande valor, que deixa uma lacuna irreparável na vida de todos nós”, declarou a governadora.
