Já ouvi muitos políticos e jornalistas falarem sobre esse assunto sem que conheçam a realidade dos fatos, principalmente no que tange logística e controle de estoque.
Estou buscando esse assunto devido a um debate, hoje, na Assembléia Legislativa, depois da sessão, entre jornalistas e deputados. Observa-se que discutem sem ter nenhum parâmetro técnico para o debate em questão.
Sem nenhum argumento plausível, apenas baseado no senso comum, alardearam que o Hospital Presidente Vargas vai ser reformado usando o artigo 24º da Lei das Licitações 8.666/93, de caráter emergencial, usando como justificativa as más condições físicas para doenças infecto-contagiosas.
Primeiramente, os desenformados devem saber que existe uma comissão de controle de infecção hospitalar. No Brasil em 1994, o Ministério da Saúde avaliou a magnitude das infecções hospitalares, cujo resultado foi devastador, principalmente pelas péssimas condições de infraestrutura das unidades hospitalares. Fator que ganhou maior dimensão depois da morte de Tancredo Neves, que contraiu infecção no Hospital de Base de Brasília. Com isso, a Lei Federal 9.431 de 06/01/97 instituiu a obrigatoriedade da existência da Comissão de Controle de Infecção Hospitalar (CCIH) e de um Programa de Controle de Infecções Hospitalares (PCIH), definido como um conjunto de ações desenvolvidas deliberada e sistematicamente, tendo como objetivo a redução máxima possível da incidência e gravidade das infecções nosocomiais.
Os resultados dos controles de infecção hospitalar são oscilantes, podendo de um exame para o outro está abaixo do exigido ou acima. Caso esteja acima, a unidade hospitalar tem por obrigação, ainda mais num hospital como o citado acima, buscar as causas e recuperá-las de imediato, por isso foi usado o artigo 24º da Lei das licitações. Por outro lado, os pacientes serão removidos para uma parte onde não sofrerá alterações.
Uma das coisas que a maioria dos políticos, jornalistas e demais profissionais precisam saber é que o sistema de saúde sempre estará sujeito a dispensa de licitação e inexigibilidade, visto que seus consumos são esporádicos e seus fornecedores na maioria são únicos.
Vou explicar:
Como já disse, trabalhei por 13 anos na Rede de Hospitais Sarah, exatamente na área de suprimento e logística, cujos métodos de controle de estoque e de armazenagem, em Brasília e São Luís, ainda são os que foram montados por mim.
Quando vim para São Luís, o Sarah contratou um profissional vindo da indústria automobilística, que trabalha com um estoque programado, ou seja, de acordo com a linha de produção desejada, deixando um estoque mínimo e de segurança quase inexistente. Então, ele comprou um sistema de controle chamado Trevisan (sistema fechado) e colocou em prática no Sarah de Brasília. Com seis meses que estava aqui, fui chamado as pressas a Brasília, onde constatei que o programa não era viável ao controle de estoque hospitalar, mas sim industrial. Pois seus controles informatizados não chegavam ao que podemos chamar razoável ao que se espera, cujo cálculo apenas se aproxima do estoque mínimo e de segurança: “CMM : 30 (dias de funcionamento) X PE X 125%”, dessa forma chega-se a controlar alguns produtos na área hospitalar, classificado na curva ABC em “C”.
O consumo médio mensal de um sistema hospitalar é completamente esporádico, visto que ninguém pode prever uma epidemia ou uma infecção generalizada. Explicarei: Volto ao Sarah de Brasília, lá o 5º andar é de lesado medular, ou seja, uma unidade de tetraplégicos e paraplégicos em estado de paralisação. Imaginem quando dava um surto de diarréia nesses pacientes!!! Adeus programação!!! O estoque máximo calculado com índices altíssimos para três meses ia embora numa semana. Fazer o quê? A compra por dispensa de licitação em caso emergencial. Portanto, não esqueçam nunca que hospitais têm seus consumos esporádicos e não programados como os demais seguimentos.
A inexigibilidade na saúde. Os setores hospitalares que mais usam desse artifício são exatamente o Laboratório e o Centro Cirúrgico, visto que seus equipamentos na maioria esmagadora só aceitam Kits do fabricante do aparelho.
Como se ver, não se discute assuntos desconhecidos, sem ter amparo técnico e científico para tal, pois assim ficará no senso comum sempre.
Só para clarear a visão retrograda, o Dr. Campos da Paz lutou pela Associação das Pioneiras Sociais exatamente para que o Sarah não fosse regido pelas leis que regulamentam os serviços públicos no Brasil, principalmente a lei das licitações, que prejudicava o andamento eficaz do hospital e, principalmente, da pesquisa.
Hospital lida com vida humana e não com produção, que pode esperar uma modalidade como carta convite, tomada de preços, concorrências públicas e os famosos pregões eletrônicos.

Suas considerações são bastante convincentes, porém o que se assiste por esse País a fora é a utilização de forma indiscriminada daquilo que poderíamos chamar de “exceção à regra”.
A Lei de licitações em seus artigos 24 e 25 tratam de dispensa (É dispensável a licitação) e da inexigibilidade (É inexigível…) respectivamente tratam de situações extremas, onde as condições não permitem alternativas que não sejam aquelas imposta e o gestor pode, veja bem a lei permite que se use desse expediente para sanar um problema que exige solução imediata e que de forma alguma pode ser adiado.
Não me parece razoável que em nome da “urgência” tudo seja feito ao arrepio da lei, e o que tem se visto são pessoas se utilizando desse expediente para fazer coisas que nada tem haver como o que oriente a legislação. O planejamento, a programação, a previsão são parte importante em todo processo de gestão, e o que se assiste são autoridades tomando medidas sem o planejamento adequado e fazendo improvisações que sempre causam prejuízos de todos os tipos para a sociedade.
Alegar “urgência” para descumprir o que determinam as leis tem sido um artifício que gestores desprovidos de responsabilidade e de compromissos com os interesses da sociedade têm usado, de forma indiscriminada para drenar os recursos do contribuinte para os ralos da corrupção.
Em nosso Estado as coisas estão sempre sendo adiadas e quando alguma coisa vai ser feita tem sempre alguém alegando a famigerada “urgência” para incorrer neste expediente macabro que tantos males tem causado ao nosso povo, que é o desvio do dinheiro público para os bolsos dos empresários aliados dos políticos. E é por essas e outras que somos carentes de bons hospitais, boas escolas, boas estradas e tantas outras coisas que perdemos pelas falta de compromisso e de responsabilidades dos nossos gestores que estão sempre buscando uma oportunidade para burlar as leis.
A licitação deve fazer parte de todas as ações dos gestores públicos e aquele que assim não o fazer dão mau exemplo e devem ser severamente punidos e banidos da vida pública.
Antonio, você tem razão em alguns pontos. Primeiro devemos voltar quando as compras e serviços para os serviços públicos eram regidos pelo Decreto 200. Era duro e as dificuldades deixa vários serviços essencias públicos parados. É certo afirmar que a Lei 8666 deixou várias aberturas, como a própria dispensa de licitação por urgência/emergência e a inexigibilidade. No entanto, para se adquirir materiais ou serviços por urgência/emergência o processo tem que está bem fundamento, caso contrário não cabe. A inexigibilidade, por sua vez, ainda é mais fácil saber se o processo condiz com a verdade, pois basta pedir ao fornecedor a certidão de que ele é o fornecedor úncio. Por isso, se a tanta falcatrua é porque os órgãos fiscalizadores não estão nem aí pra tudo isso. Muitos confudem a lei das licitações, pois acham que devem ser adquiridos os matérias e os serviços sempre pelo menor preço. Isso é um tremendo engano. Pode sim comprar pelo maior preço. Então vejamos: tudo depende do parecer técnico de quem pediu o material ou serviço, justificando dentro dos paramentros legais a escolha pelo maior preço. Vou dar um exemplo: O Hospital Sarah (ainda regido pelo serviço público) só usava produtos da Ceras Jonhson para higienização do hospital, claro que concorrentes entravam na tomada preço ou concorrência (esses são materiais que não se justifica, por exempo, comprar por urgência e emergência, visto que seus consumos não são esporáticos). O pedido de compra tem que colocar na especificação do material o seguinte, vou usar o produto chamado de Desolin: “Desinfentante líquido biodegradável com diluição de 20% de água com teor de desifecção hospitalar. marca Desolin ou similar”, só se pode usar o nome de um produto com o uso depois “similar”, visto que já pode haver no mercado um produto semelhante em tudo, mas de outro fabricante. Várias empresas cotam seus produtos, mas suas especificações não codizem com a especificação exigida, com isso o parecer técnico vai dar a sustentabilidade pela compra pelo maior preço.
Um dos grandes problemas é se basear apenas nas resenhas editadas nos Diários Oficiais, é preciso conhecer o processo de capa a capa e, assim tirar suas conclusões. Veja um exemplo disso. No governo José Reinaldo vi no D.O. uma compra de livros didáticos, por inexigibilidade, no meio do ano (coisa que não justifica) por R$ 20 milhões. Estranhei a compra, mas não tinha embasamentos para comentar até que ponto estava errado, com isso fui a Seduc, na época o secretário era o Edson Nascimento, e pedir uma cópia de capa a capa. Diante do processo foi que vi as ilicitudes que iam do pedido de compra até o pagamento de livros didáticos para uma gráfica fundo de quintal do Paraná, que não condizia com a inexigibilidade, pois a FDT, a Sipione etc. tinham livros com preços menores e com teor didático bem acima do escolhido. Essa fraude é uma das mais utilizadas pelo serviço público. Outra comum é aquisição de uma determinada quantidade e o recebimento da metade, porém atestam o recebimento de todo. Poderia elecar várias formas, mas não é só através do processo licitatório que se rouba…
Caro jornalista, esta questão da inexigibilidade na saúde realmente é, muitas da vezes, necessaria para manter o bom funcionamento e atendimento da unidades de Saúde.
Agora, o qu eeu não entyendo é, qual o motivo de todo esse MEDO do secretario RICARDO MURAD que a imprensa tem , ou será acordo com ele?
talvez nobre professor CAIO, você não saiba e por isso esteja fora da lista desses que falei da imprensa, com acordos ou medos.

MOTIVO? NENHUM, A EMPRESA NÃO SERIA A QUE ELE QUERIA PARA GANHAR MAIS DINHEIRO, A EMPRESA TINHA GANHO LEGALMENTE UMA LICITAÇÃO, AI NÃO DEVERIA FAVORES AO SECRETARIO DE SAÚDE MAIS SEM NOÇÃO DE SAÚDE DA HISTORIA DO MARANHÃO.
MAS AGORA A IMPRENSA CONVENIADA NÃO MOSTRA ESTA REALIDADE. E SIM CONTA COMO VANTAGEM QUE O SECRETARIO RICARDO MURAD VAI REFORMAR EMERGENCIALMENTE ESTE HOSPITRAL. ISSO É UMA FALTA DE RESPEITO COM A POPULAÇÃO MARANHENSE.

Desconheço esse cancelamento, pois não trabalho na SES. Porém, o que eu mostrei foi no sentido das pessoas saberem de fato o porquê do uso da dispensa de licitação e inexigibilidade na área de saúde, não só no Maranhão, mas em todo o país. Seus estoques não são regulares pela falta de prever epidemias e outros fatores e a inexigibilidade, em conformidade com que escrevi. Isso é preciso que todos tenham conhecimento, visto que saúde mexe com vida e pelo consumo esporátido leva a isso, coisa diferente de outros seguimentos como industria, comércio etc.
Sim caro Prof Caio, realmente seu texto mostra a necessidade das inesigibilidade e as urgercias, mas neste mesmo caso usa como exemplo uma obra que foi cancelada com contrato assinado, e ja havia necessidade a mais de um ano senão não seria feita a licitação, e depois decreta-se carater de emergencial, para poder burlar a lei e se locupetra das beneces do dinheiro publico sem licitação, coisa que no meu comentario anterior chamo atenção e vc alega não ter conhecimento, coisa que acredito sim.

Ele outro dia estava em uma reunião e quando falou sobre alguns convenios em uma reunião a qual ele estava cobrando credenciamento dos medicos, um medico disse a ele que estava errado e ele garantiu que não, sobre os convenios, ai foi atraz e descobriu-se que realmente que estava certo era o medico, ao afirmar que os programas não estavam cadastrados.

The new Zune browser is surprisingly good, but not as good as the iPod’s. It works well, but isn’t as fast as Safari, and has a clunkier interface. If you occasionally plan on using the web browser that’s not an issue, but if you’re planning to browse the web alot from your PMP then the iPod’s larger screen and better browser may be important.
