“Cagada” do Judiciário!!!
Quem errou o secretário judiciário ou o juiz?
A sentença dada para cassar o mandato do deputado Hemetério Weba (PV) está completamente equivocada, com erros gritantes, demonstrando que pode ter havido erro por parte do Secretário Judiciário Rafael Duarte Ribeiro por só ter anexado aos autos apenas o original, que foi entregue no dia 18/04, esquecendo de anexar as cópias dos emails e protocolo provando que o recurso foi entregue dentro do prazo.
Por outro lado, Pode ter havido erro por parte do juiz Rodrigo Costa Nina, que não leu todas as páginas do processo, atendo-se apenas a entrega do original, no dia 18/04.
A sentença de condenação saiu no Diário da Justiça no dia 30/03/2011, com isso a defesa do deputado teria até o 14/04/2011 (prazo final) para apresentar a apelação.
O advogado do deputado, Dr. Enéias, cumpriu o prazo, pois enviou via email (comarcaslp@gamail.com) a apelação. No mesmo dia (14/04), a Comarca respondeu acusando o recebimento, informando que estava em anexo, a petição com o carimbo de recebimento datado do dia (14/04), assinado pelo secretário judicial Rafael Duarte Ribeiro.
Diante da entrega via email, o advogado do parlamentar teria que apresentar o original com 05 dias, ou seja, até o dia 19/04, mas protocolou no dia 18/04/2011.
Segundo Dr. Enéias, ele ainda não foi notificado dessa decisão do juiz, mas já adiantou que entrará com Embargo de Declaração pedindo o efeito modificativo da decisão, suprimindo o equivoco.
Por outro lado, o deputado Hemetério Weba adiantou que entrará com processo contra o Estado por danos morais, visto que ficou alardeado que ele não cumpre as determinações judiciais e, principalmente, por noticiarem que ele já estava cassado.

Sou leigo no assunto, entretanto malandragem, acho que os advogados do homem gostam de viver perigosamente. Pelo que pude entender eles tinham 15 dias para recorrerem, sendo que o último dia era 14/04/2011. Então malandragem deixaram para protocolar o recurso no último dia, assim o fizeram via Email. As leis brasileiras deixam muitas brechas, então na interpretação da lei os advogados ganharam mais 05 dias para apresentarem os documentos originais, que realmente entregaram dia 18/04/2011.
Vamos analisar:

O dia da entrega dos documentos originais: 18/04/2011 (fora do prazo estipulado que era dia 14/04/2011)
Fica a pergunta se o Juiz julgar que o prazo final para protocolar tudo encerraria dia 14/04/2011?
O tema “cagada” do judiciário, não soou bem, porem Hemetério Weba não é nem uma noviça rebelde, se trata de um político com um histórico grande de corrupção. É fato, nessa sentença ele foi condenado por improbidade administrativa. Os comentários na internet é que a justiça errou, mais o maior erro é do nobre deputado que cometeu os crime e foi condenado.
O que os advogados então tentando é apenas um novo julgamento, HEMETÉRIO WEBA foi julgado CULPADO por improbidade administrativa (entre os atos de improbidade estão o enriquecimento ilícito, o superfaturamento, a lesão aos cofres públicos, o “tráfico de influência” e o favorecimento, mediante a concessão de favores e privilégios ilícitos, e a revelação de fato ou circunstância de que o funcionário tem ciência em razão das atribuições e que deva permanecer em segredo.)
