Antes de entrar propriamente dito na acusação do deputado Roberto Costa, vale perguntar: Será que ninguém nessa cidade entrará com uma representação na Justiça contra o reajuste abusivo do IPTU aprovado pelos vereadores de São Luís?
Por outro lado, a Câmara de Vereadores de São Luís não se ateve a observância do princípio da moralidade para aprovar um aumento imoral? De acordo com pareceres de técnicos da Prefeitura, esse aumento substancial é constitucional, visto que imóveis com valores de até R$ 50 mil estarão isentos de pagamento de IPTU, ficando a conta por conta dos proprietários dos imóveis acima desse valor, que é a minoria da cidade.
Primeiramente, o prefeito João Castelo e os vereadores se basearam em que índice inflacionário, qual foi o órgão que fez as avaliações para chegar ao consenso de valorização e de desvalorização dos imóveis para tomar essa medida? Tudo indica que houve um conchavo político entre os dois poderes, uma vez que a maioria esmagadora dos eleitores da capital mora em imóveis que foram estipulados com valores inferiores a R$ 50 mil, enquanto que os proprietários de imóveis de valores superiores é uma minoria que não traduz em voto pelo clientelismo. A própria deputada Gardeninha disse-me que esses que não pagarão IPTU receberão certificados.
Outro fator preponderante nessa discussão é a de que esse tipo de aumento, conforme determina a Constituição Federal, só valerão para a Legislatura subseqüente.
Foi diante desse clientelismo disfarçado, que o deputado Roberto Costa subiu a tribuna nesta quinta-feira (05), para denunciar a fraude que a Prefeitura de São Luis cometeu na Ata de Reunião da Validação Técnica da Planta Genérica do IPTU.
As denuncias chegaram ao deputado no inicio da semana, através da investigação do promotor de Justiça de Defesa da Ordem Tributária e Econômica, José Osmar Alves.
Roberto Costa questionou primeiramente as reclamações da população, pelas cobranças abusivas do IPTU, que cujos valores variavam de R$ 2.500 em 2010, para mais de R$ 13 mil reais em 2011.
O parlamentar explicou que por conta do excelente trabalho do promotor, constatou-se inconstitucionalidade na Lei pela não participação de uma comissão na elaboração da Planta Genérica, como determina o art. 201 do Código Tributário.
Ou seja, seria necessário que uma comissão formada por entidades da sociedade civil, participasse das audiências.
De acordo com a ata de reunião apresentada pela Prefeitura, as entidades: FIEMA, SINDUSCON, CREA, FECOMÉRCIO, CRECI E ASSOCIAÇÃO COMERCIAL, participaram e assinaram o documento. O promotor José Osmar convocou os representantes das entidades citadas na ata para colher os depoimentos e constatou que, nenhum dos mencionados nela participaram ou assinaram o documento, evidenciando desta forma, um ato fraudulento de falsidade ideológica.
“É um absurdo, ou melhor, é um caso de polícia. O intuito da Prefeitura é tirar dinheiro da população contribuinte. Agora, não podemos aceitar, é que estamos vivendo numa cidade sem nenhuma estrutura e a Prefeitura de São Luís, se preocupa em formar uma quadrilha para enganar a população”, esbravejou o deputado Roberto Costa.
Roberto Costa informou ainda, que as investigações do Promotor, já foram encaminhadas á Procuradora Geral de Justiça, Fátima Travassos, para que seja impetrada, em regime de urgência, uma Ação Direta de Inconstitucionalidade.
Diante das denuncias e do aumento abusivo, os deputados Jota Pinto, Eliziane Gama e Raimundo Cutrim, questionaram a atitude da Prefeitura de São Luís. O certo é que os três parlamentares esperam que os ludovicenses não paguem o IPTU com um aumento tão abusivo como esse.
Na verdade, não se pode conceber um projeto desses do Executivo, que vez por outras está sempre atrás de recursos e compensação para aqueles que lhe garante votos. Contudo, a Câmara de Vereadores de São Luís é simplesmente uma Casa de interesses politiqueiros e não de representantes do povo. Pra que existe aquela Casa? O debate sobre esse aumento abusivo era para ser discutido lá na Câmara de Vereadores e não na Assembléia Legislativa. Como a Câmara não existe, a defesa do povo ludovicense acaba sendo no legislativo estadual.

Hands down, Apple’s app store wins by a mile. It’s a huge selection of all sorts of apps vs a rather sad selection of a handful for Zune. Microsoft has plans, especially in the realm of games, but I’m not sure I’d want to bet on the future if this aspect is important to you. The iPod is a much better choice in that case.
