Esses artifícios eram comuns na Serventia Extrajudicial do 1º Ofício de Brejo até dezembro de 2010, segundo relatório entregue ao corregedor-geral da Justiça, Antonio Guerreiro Júnior. O levantamento retroage a essa época, quando o corregedor indiciou interventora para a serventia.
Apesar de preliminar, o documento elaborado por técnicos da Corregedoria Geral da Justiça (CGJ) expõe ciclo de ocorrências que tornam suspeita, por exemplo, a relação entre proprietários e imóveis urbanos e rurais na região.
Escrituras supostamente canceladas pelo Iterma (Instituto de Terras do Maranhão) não foram precedidas de ordem judicial e não consta nos atos de escritura e registro referência a essas revogações, descobriu a Corregedoria. Ao todo, o relatório aponta 18 irregularidades no cartório de Brejo.
Apesar dos frequentes pedidos para entrega do acervo digital, o registrador afastado levou consigo esses arquivos. Ficaram na serventia apenas parte dos livros – vários com páginas danificadas por picote, o que inviabiliza comprovar a autenticidade de documentos. Há livros de “Protestos” desaparecidos e outros com numeração desordenada.
Até a posse da interventora, o registrador anterior não possuía protocolo de Registro de Imóveis e também cartões de assinatura das firmas registradas na serventia.

“Grande parte das operações bancárias garantidas por hipoteca não foram lançadas em livros, e há propriedades onde não consta o nome dos devedores, apesar de documentos comprovarem a transferência através do registro”, diz o corregedor referindo-se a trecho do relatório.
Como registros anteriores da matrícula de propriedade não representavam o mesmo imóvel, o cartório estava impossibilitado de emitir certidões relativas à produção de cadeias sucessórias, detectou a CGJ.
Os últimos livros de “Notas” – que o titular afastado chamava “Encadernação” – foi possível comprovar a ausência de folhas e de inúmeros atos sem a assinatura das partes e do responsável pela serventia. Os poucos documentos apresentados para lavratura do ato estavam grampeados nas escrituras.
Guerreiro Júnior vai esperar exame completo da serventia de Brejo para anunciar providências. A mais provável é que o relatório seja enviado à Polícia Federal, um parceiro habitual da Corregedoria na identificação de golpes cartorários no estado. “Cópia do processo já foi solicitada pela Procuradoria Geral do Estado”, informa o corregedor.
