É difícil encontrar alguém que não tenha passado por um aborrecimento gerado pela utilização indevida de seus dados cadastrais. Os consumidores acreditam que as empresas trocam informações cadastrais valiosas, como nomes, endereços, telefones e contas de e-mail. Essa é a única explicação para que uma companhia com a qual nunca tiveram contato saiba tantos detalhes de suas vidas. Como não há uma legislação específica para o tema e a fiscalização de tais práticas é nula, os brasileiros sofrem com os abusos e o incômodo de ter assuntos pessoais expostos.
Dispositivos legais para a proteção das informações existem apenas na Constituição e no Código de Defesa do Consumidor. Entretanto, nenhum deles rege de maneira específica a proteção e o manuseio dos dados. O Brasil é uma exceção à tendência mundial de monitoramento.
Foi aberta uma consulta pública para coletar a opinião de vários setores da sociedade. O prazo para enviar sugestões terminouem abril. Agora, estão classificando as colaborações. A expectativa é de que, após essa etapa, seja elaborado um projeto de lei com regras claras para a coleta e o uso dos dados.
Com o texto proposto, muitos problemas, como uso indevido do nome, publicidade direcionada e invasão de privacidade nas correspondências serão evitados. Especialistas acreditam que a falta de uma legislação sobre o tema deixa os brasileiros desprotegidos. “Sem regulamentação, esses dados são usados para formar perfis de consumidores e oferecer produtos e serviços direcionados, de forma abusiva e indevida, sem autorização”, ressalta os especialistas.
Todo financiamento ou operação de crédito exige informações detalhadas do contratante. Por isso, é natural que empresas desse segmento tenham um banco de dados bastante abrangente de seus clientes. Serviços de assinatura, como telefonia, banda larga, tevê por assinatura, entre outros, também captam um volume expressivo de informações. Mas, em todos esses casos, o consumidor tem alguma noção de quem detém seus detalhes pessoais. Na internet, os dados são coletados, armazenados e transmitidos com muito maior rapidez, fugindo ao controle dos seus titulares.
A facilidade de manipular dados é o principal motivo para a situação atual dos consumidores, que recebem várias propagandas, cartões e ofertas de produtos e serviços.
O desafio é controlar as pessoas que podem chegar até as informações dos consumidores.
