A Vale S/A deverá pagar mais de R$ 600 mil de indenização por danos morais e materiais à esposa e ao filho menor de um empregado da empresa, que morreu em acidente de trabalho no ano passado. A decisão é do juiz titular da 3ª Vara Trabalhista de São Luís, Paulo Mont´Alverne Frota. O funcionário foi atingido na área destinada à circulação de máquinas e operários, quando uma estrutura metálica que fazia parte das estruturas do transportador de minério de ferro desabou sobre ele.
O magistrado determinou que a Vale pague, à viúva e ao filho do empregado morto no acidente, indenização por danos morais; indenização por dano material emergente para cobrir os gastos com o funeral do trabalhador e indenização por danos materiais, na modalidade lucros cessantes, no valor equivalente à remuneração do funcionário, desde a sua morte até quando ele completaria 70 anos, levando-se em conta a duração provável da vida da vítima que morreu com cerca de 35 anos de idade.
O juiz determinou também que 60% do valor relativo à indenização por danos morais a ser paga ao filho menor devem ser depositados em caderneta de poupança para liberação somente quando ele completar 18 anos ou no caso de nova autorização judicial.
A Vale alegou que não lhe cabia qualquer responsabilidade pelo acidente de trabalho e que o sinistro decorrera de culpa exclusiva da vítima. Todavia, em depoimento ao juiz, o representante da empresa declarou que fora constatado desgaste da estrutura metálica e acúmulo de minério nas estruturas, o que, segundo ele, pode ter concorrido para o desabamento que matou o trabalhador.
O representante da Vale disse, ainda, que o empregado fora atingido quando se encontrava na área destinada à circulação de máquinas e operários e que, pela gravidade do acidente e sua dimensão, mesmo que o empregado estivesse usando equipamento de proteção individual (EPI) não resistiria ao peso da estrutura que caiu sobre ele. Disse, ainda, supor que a vítima estivesse usando todos os EPIs porque a empresa exige a utilização desses equipamentos.
De acordo com o magistrado, cabia à Vale adotar medidas que garantissem aos seus empregados trabalhar sem correr risco à sua integridade física e psíquica. Mas, conforme o juiz, a empresa foi negligente no cumprimento desses deveres. Paulo Mont´Alverne afirmou que o laudo de exame pericial produzido pelo Instituto de Criminalística da Secretaria de Estado do Maranhão não deixa a menor dúvida quanto à culpa da Vale pelo acidente que vitimou o empregado e, por isso, a empresa deve arcar com todos os danos relativos ao acidente de trabalho. Segundo ele, a culpa da empresa foi cabalmente comprovada.
Para determinar o valor da indenização por danos morais que a empresa deverá pagar à viúva e ao filho da vítima, o juiz levou em conta as circunstâncias em que o acidente ocorreu, a situação econômica e social do trabalhador e da empresa (uma das maiores, senão a maior mineradora do mundo, cujo lucro, no primeiro trimestre deste ano, segundo o site UOL, chegou a R$ 11,291 bilhões), a gravidade do ato e a repercussão da ofensa e a intensidade de sofrimento causado. Na sentença, o magistrado também ressaltou que a Vale é reincidente nesse tipo de negligência com os seus empregados e que esse não foi o primeiro acidente de trabalho envolvendo funcionários da empresa. Nesse sentido, o juiz citou decisões de outros TRTs e do Tribunal Superior do Trabalho (TST) em que a empresa foi condenada.
O juiz também determinou que a VALE constituísse um capital, cuja renda fosse capaz de assegurar o pagamento da indenização por danos materiais da modalidade lucros cessantes. Além disso, a VALE deverá incluir os nomes dos reclamantes na sua folha de pagamentos, de forma que, mensalmente, a viúva e o filho do empregado falecido possam receber as suas pensões em conta salário.
